Gans Man Faces Burglary, Gun Charge


A Gans man who allegedly kicked in a door at a Sallisaw apartment was charged Jan. 20 with second-degree burglary and possession of a firearm after conviction or during probation.

Darin Wayne Schmidt, 28, was arrested at the apartment complex when police responded to the incident. Upon arrival at the scene, officers saw a man, later identified as Schmidt, crawling on the ground in front of the apartment.

Schmidt was handcuffed and searched. Officers found several .38-caliber bullets in his pockets. A red and black backpack found at the scene was found to contain a .38-caliber revolver.

Schmidt was transported to the Sequoyah County Jail. His bond was set at $15,000 and his next court appearance is set for 9 a.m. Feb. 26 before Judge Kyle Waters.

Second-degree burglary is punishable by up to seven years in prison, and the weapons charge is punishable by up to 10 years in prison.
