The case against a Gore man, accused of 17 counts of rape and lewd molestation was dismissed Friday in Sequoyah County District Court, Sallisaw. The case was filed in June 2014.
Troy Sands, 33, was accused of the rape and molestation of two sisters, who were six and seven years old at the time, between 2008 and 2010.
Assistant District Attorney Stacey Slaughter said the case was dismissed without prejudice, meaning it can be filed again.
Slaughter said, “In depositions about two weeks ago, the girls’ testimony was not as strong as we had hoped. Any time you have delayed reporting, especially where young children are involved, there can be a problem with recollections. We had hoped we had a stronger case.”
Slaughter said if new evidence is uncovered, the case may be refiled.
In the meantime, the motion to dismiss is under the condition that Sands have no contact with the alleged victims or their immediate family.
Sands’ trial on the charges was scheduled to begin this week in district court.
