Vian Woman Faces Drug Charge

A Vian woman was arrested June 9 and charged with unlawful possession of a controlled drug with intent to distribute, a felony.

Devan Brown, 39, was also hit with a pair of misdemeanors, unlawful possession of drug paraphernalia and failure to maintain insurance or security.

According to a police report, on June 9, a Sallisaw police detective was driving in the area of West Chickasaw Street when he saw a black Mazda parked at a residence that had been the subject of a May 20 drug raid.

A few minutes later, the officer saw the car leave the residence and head north on Ash Street toward Cherokee Avenue. The vehicle was stopped after a short pursuit.

When the officer spoke with Brown, the driver of the Mazda, she appeared nervous and had a hard time controlling her breathing. She was unable to provide insurance information on the vehicle.

The officer asked Brown to return to his police cruiser but she became defensive and argued with him. When she continued to refuse to leave her vehicle, the officer asked her if she had something hidden where she was sitting. Admitting that she did, she then reluctantly exited the vehicle, leaving behind a twisted plastic baggie containing an off-white crystalline substance lying in her seat.

A search of the Mazda turned up a Marlboro cigarette pack holding a beige cloth bag with two empty baggies, a modified red straw and a green-colored baggie containing the same crystalline substance. Police found two glass smoking devices in Brown’s purse and discovered notebooks with alleged drug notations.

The total weight of the suspected drugs was 8.6 grams. Brown was transported to the police department for booking. 

Brown faces up to five years in the Department of Corrections and a fine of up to $20,000 on the felony count. She faces up to a year in prison on the paraphernalia charge and a fine of up to $250 and 30 days in prison or both.
