Brad M. Buttery, 38, of Vian was charged Oct. 20 with assault and battery with a deadly weapon in connection with a shooting that allegedly involved his brother, Matt Buttery.
Brad Buttery entered a not guilty plea to the charges filed in Sequoyah County District Court in Sallisaw. His case is to go to Associate District Judge Kyle Waters disposition docket on Dec. 7. Brad Buttery is free on a $15,000 bond.
According to the report filed by the investigating police officer, Matt Buttery was visiting with his father when, Matt Buttery said, his father began talking negatively about Matt Buttery’s wife. Matt Buttery said he became angry and kicked over the table where he and his father were sitting. When he went to get his belongings and leave, Brad Buttery said “he was going to shoot Matt. Matt said Brad was standing on the porch holding a rifle…Matt said when he grabbed his bag…Brad shot him in the hip.”
Matt Buttery then left, and was driven to W.W. Hastings Hospital in Tahlequah by a friend. He was later sent on to a Tulsa hospital for surgery.
The shooting occurred on Oct. 15.
The reporting officer said when he attempted to speak with Brad Buttery and his father, they were advised by their attorney to not to speak to the officer.
Assault and battery with a deadly weapon is punishable by imprisonment for up to life.
