Mother’s Hearing, for Child’s Death, Set for June 26


The preliminary hearing for a 27-year-old Roland woman, charged with murder for the death of her 53-day-old baby, will be held June 26.

District Judge Kyle Waters set the preliminary hearing for 9 a.m. June 26 in Sequoyah County District Court, Sallisaw.

Brantley Leigh Marthers is charged with either murder in the second degree or the alternative second-degree manslaughter.

The charge alleges that, on March 12, 2016, Zaylor Gonzalez died as a result of co-sleeping with his mother, Marthers, who was allegedly under the influence of Methadone and/or methamphetamine.

According to the investigator’s report filed with the charges, Marthers screened positive for methamphetamines, amphetamines and other drugs shortly after her son’s death.

The second-degree murder charge is defined as creating an immediate and high degree of risk of death to another person and reckless disregard for the life and safety of another…without premeditation. The second-degree manslaughter charge is defined as being the result of culpable negligence.
