The fourth preliminary hearing date for Angela Gray of Muldrow has been set for 1:30 p.m. Jan. 26 in Sequoyah County District Court in Sallisaw.
Gray, 40, of Muldrow is charged with conspiracy, child endangerment by driving under the influence and furnishing an alcoholic beverage to a minor.
Previous preliminary hearing dates, in October, November and December, were continued by the court.
According to the charges, Gray is accused of conspiring to clean up the scene of an ATV accident, on Sept. 1, 2013, that left a young man, Christian Mayberry, with severe brain trauma. The purpose was to exonerate Gray from any criminal wrong doing, the charges allege.
In a jury trial in August, in which Angela Gray faced a charge of failure to stop at an accident resulting in non-fatal injury, the jury deadlocked on that charge and a mistrial was declared. Jurors told District Judge Jeff Payton that, based on the testimony, they could not decide who was driving the ATV at the time of the crash, which was south of Muldrow. Angela Gray testified Mayberry was driving, and Mayberry testified Gray was driving. Mayberry also testified that Gray offered him a beer, which he declined. Gray was also found not guilty of contributing to the delinquency of minors.
Assistant District Attorney Michael Ashworth, who tried the first case, said he would retry the case then filed the new charges on Aug. 31.
