A motion for a change of venue was filed Monday in Sequoyah County District Court in Sallisaw in the case of the state verses Angela Gray of Muldrow. Gray, 39, faces three charges in relation to an ATV accident on Sept. 1, 2013, that left Christian Mayberry, a Muldrow teen, with severe brain trauma. The motion, filed by Gray's attorney, Gary Buckles of Poteau, argues the case has received so much media and social coverage that the minds of potential jurors are prejudiced, and the defendant cannot receive a "fair and impartial trial" in Sequoyah County. The motion mentions numerous references to the case in area newspapers, on area and national broadcast media, and in social media on the Internet, and a Facebook page set up for Christian Mayberry, Mayberry was 17 at the time, and in the charges against Gray, it is alleged that Gray and two teen boys cleaned up the site of the ATV wreck while Mayberry lay unconscious in a ditch, without medical help. Gray was charged Aug. 14 with failure to stop-accident resulting in non-fatal injury, contributing to the delinquency of minors and furnishing alcoholic beverage to a minor. Gray entered a not guilty plea to the charges on Aug. 20. The case is next set on a jury trial sounding docket Dec. 4, when the judge may decide if the defendant is to go to a jury trial.
